Injured Military

Fighting for Soldiers With Disabilities

Our founder, James E. Smith Jr., served as a JAG officer in South Carolina Army National Guard for eight years. Then he resigned and reenlisted to pursue a commission as an infantry officer. That meant going through basic training at age 37. He did it because he wanted to serve his country by leading soldiers in combat.

Captain Smith got that opportunity in Afghanistan, where from February 2007 until July 2008, he was deployed as an infantry officer with the 218th Brigade Combat Team.

Getting Injured Military Members the Benefits They Deserve

Few people understand better than attorney James E. Smith Jr. the challenges faced by members of the military whose disability claims have been delayed, denied or mishandled, leaving injured soldiers without the benefits they are entitled to receive. He has been in combat, he knows military law and, as a personal injury lawyer, he knows how to get results for injured members of the military.
Injured Military

If you were injured during your service in the military and your disability claims have been denied, please contact our law firm in Columbia, South Carolina, for a consultation about your case.

We have successfully represented the claims of injured members of the military in the U.S. Court of Appeals for the Federal Circuit in Washington, D.C. Our lawyers have successfully appealed disability claims involving injuries such as:

• Posttraumatic stress disorder (PTSD)
• Traumatic brain injuries (TBI)
• Agent Orange
• Loss of hearing

Service members who suffered injuries that do not show up on empirical tests or those that are difficult to link to military service are more likely to be denied benefits than those who have obvious injuries, like amputations or paralysis from spinal cord injuries.

If you have a hearing loss, for example, the military may claim that the loss of hearing was from listening to loud music, not from shooting a rifle or being near a blast as part of your line of duty.

Attorney Smith represents members of all branches of the military, including those stationed at Fort Jackson, Shaw Air Force Base (AFB), Charleston AFB, Charleston Naval Weapons Station, Beaufort Naval Hospital, Beaufort MCAS and Parris Island Marine Corp Depot.
